These Terms govern your use of the voice chat feature in the Poolify billiards game operated by Shenzhen Jiaqi Technology Co., Ltd.
These Terms and Conditions (the "Terms") govern your use of the voice chat feature (the "Voice Chat") provided in the billiards game (named Poolify) operated by Shenzhen Jiaqi Technology Co., Ltd (hereinafter referred to as "we", "us", or "our"). By accessing or using the Voice Chat, you agree to be bound by these Terms, our Poolify End-User License Agreement (EULA), and our Privacy Policy. If you do not agree to these Terms, please refrain from using the Voice Chat.
Your use of the Voice Chat constitutes your full and unconditional acceptance of these Terms, including any updates or modifications we may make from time to time. We reserve the right to revise these Terms at any time without prior notice; the updated version will be posted within Poolify, and your continued use of the Voice Chat after the update constitutes your acceptance of the revised Terms.
You must be at least 13 years of age to use the Voice Chat. If you are under 13, you are prohibited from using the Voice Chat. If you are between 13 and 18 years of age, you must obtain the consent of your parent or legal guardian before using the Voice Chat, and your parent or legal guardian must agree to these Terms on your behalf.
The Voice Chat is provided solely to facilitate communication between players during Poolify sessions, including coordinating gameplay, discussing billiards strategies (such as bank shots, breaks, or defensive plays), and engaging in friendly, respectful banter related to Poolify.
You agree to use the Voice Chat in a manner that is consistent with the spirit of fair play and sportsmanship inherent to billiards, and to treat all other players with respect and courtesy at all times.
You are strictly prohibited from engaging in any of the following conduct when using the Voice Chat. Violation of this section may result in immediate suspension or termination of your Voice Chat access, suspension or termination of your Poolify account, and other legal remedies as applicable:
We reserve the right to monitor, record, review, and moderate all communications made through the Voice Chat to ensure compliance with these Terms and our other policies. We may use automated tools and human moderators to enforce these Terms, and we may store voice recordings for a limited period for moderation and investigation purposes only.
We are not obligated to monitor all Voice Chat communications, but we may take action at our sole discretion if we become aware of any prohibited conduct. Such actions may include, but are not limited to, muting your Voice Chat access, restricting your ability to use the Voice Chat temporarily or permanently, warning you, suspending or terminating your Poolify account, and reporting violations to relevant authorities if necessary.
Moderation decisions are made based on the context of the communication, the severity of the violation, and any prior violations by your account. We reserve the right to skip warnings and impose more severe penalties for egregious violations, such as hate speech, threats, or repeated harassment.
You are solely responsible for all communications you make through the Voice Chat, and you agree to indemnify and hold harmless us, our affiliates, employees, contractors, and agents from any claims, damages, liabilities, or expenses arising from your use of the Voice Chat or your violation of these Terms.
If you encounter any prohibited conduct or inappropriate behavior in the Voice Chat, you agree to use Poolify’s built-in reporting feature to notify us. You may also contact our support team with details of the incident, including the username of the offending player, the date and time of the communication, and a description of the violation, to assist us in taking appropriate action.
You acknowledge that you may mute other players at any time to avoid unwanted communications, using the in-Poolify mute function provided.
We collect and process your voice data and related information in accordance with our Privacy Policy. By using the Voice Chat, you consent to the collection, storage, and processing of your voice data for the purposes of providing, moderating, and improving the Voice Chat feature.
We will not sell, rent, or share your voice data or personal information with third parties except as required by law, or with your explicit consent. We will retain your voice data only for as long as necessary to fulfill the purposes outlined in these Terms and our Privacy Policy, or as required by applicable law.
We shall not be liable for any damages, losses, or injuries arising from your use of the Voice Chat, including but not limited to damages resulting from inappropriate communications by other players, technical errors, or service interruptions. We do not guarantee that the Voice Chat will be uninterrupted, error-free, or secure.
We shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, even if we have been advised of the possibility of such damages, arising from your use of the Voice Chat.
You acknowledge that you use the Voice Chat at your own risk, and that we are not responsible for the conduct of other players or any content transmitted through the Voice Chat.
We may terminate or suspend your access to the Voice Chat at any time, without prior notice, for any reason, including but not limited to your violation of these Terms, our Poolify End-User License Agreement (EULA), or any other Poolify rules.
Upon termination or suspension of your Voice Chat access, you will no longer be able to use the Voice Chat feature. Termination of Voice Chat access may also result in the termination of your Poolify account, at our sole discretion.
You may terminate your use of the Voice Chat at any time by discontinuing its use and, if desired, contacting our support team to request the removal of your voice data in accordance with our Privacy Policy.
These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of laws principles.
Any disputes arising out of or in connection with these Terms shall be resolved through binding arbitration in [Jurisdiction] in accordance with the rules of [Arbitration Body], unless prohibited by applicable law.
